Vindication: Second Foreclosure Sale Price 77 Times the Price of First Sale
In this post, we are revisiting Evans v. Finkelstein. After our objection to the first foreclosure sale in which the subject property sold for $5,200.00 was sustained and that sale vacated (you can read about the objection here), the sale was reset, and it was conducted with the Plaintiff's maximum bid hidden from view, as we had stated it should. As it turns out, our objection proved to make a huge difference, as the property sold for $400,500.00 (77 times more than the first sale price) at the second sale. We feel vindicated, but we can't help but think about the hundreds or thousands of sales that were conducted using the procedure to which we successfully objected.
